Why should companies have a whistleblowing function?

A well-functioning whistleblowing system allows an organization to identify and address potential misconduct early, which might otherwise go unnoticed in the daily operations. This is particularly valuable for small and medium-sized businesses, where employees may feel dependent on their employer, making it harder to report issues. By offering a secure channel to report suspected wrongdoing, such as violations of regulations, corruption, harassment, or criminal activity, a company can prevent financial and reputational damage that could have far-reaching consequences.

Are you aware that a whistleblower protection law has been introduced?

According to the law on the protection of individuals reporting misconduct, companies with over 249 employees are already required to have a whistleblowing function in place. As of July 17, 2022, it became mandatory for public employers with at least 50 employees and private employers with at least 250 employees to establish an internal whistleblowing system. The requirement was extended on December 17, 2023, to also include private employers with at least 50 employees.

Anonymity and protection – Whistleblowers can often remain anonymous or have their identity protected. There are also laws in many countries, including EU directives, that protect whistleblowers from retaliation or harassment for reporting misconduct.

Who can report? – The organization’s whistleblowing policy specifies who can use the system, usually employees but sometimes also suppliers, consultants, and customers.

Whistleblowing reporting channels

Once you are sure your case qualifies as whistleblowing, use the organization’s whistleblowing system. The design of this function can vary depending on the size or industry of the organization. For example, it could be a dedicated phone number or a physical mailbox at the workplace.

How does written reporting work? Do you prefer to report verbally or arrange a meeting to personally describe what happened? How does the case handler follow up after you’ve submitted your report? Is there anything else you need to do after filing your report? These are examples of questions that can be addressed in the whistleblowing policy.
